In recent years, the advancements made in the field of neuroscience have been echoed in criminal law, reigniting the discussion on culpability from the viewpoint of if it actually exists, considering the echoes of determinism on the re-found non-existence of free will. This discussion has triggered, once again, the issue of the boundaries and inter-relations between law and science, namely on whether normative or legal concepts and categories should acknowledge scientific breakthroughs. Bringing forth the theme of the limits of the (...) law, this discussion is able to provide insight, with reference to a specific problem, as to whether there are plausible legal answers in the context of the ascription of liability if the subject of law ceases to be a responsible—and thus free—person. Taking into consideration evolution both of science and criminal law dogmatic, we aim to argue that in the particular case of culpability, the desired autonomy of law has its limitations, and that without such limitations the ascription of liability would not have a correct answer. For this argument we will firstly approach the meaning of culpability as a milestone of subjective responsibility in criminal law, so that we can then analyse some arguments made regarding the impact of neuroscience on the maintenance of a concept of culpability with the meaning given above, so that lastly we can proceed to the rebuttal of the overarching impact of science on the law and advocate the autonomy of culpability within the necessary limits imposed by the needs of a plausible legal answer. The rising demographic of older adults worldwide has led to an increase in dementia cases. In order to ensure the proper allocation of care and resources to this clinical group, it is necessary to correctly distinguish between simulated versus bona-fide cognitive deficits typical of dementia. Performance Validity Tests are specifically designed to assess a lack of effort and the possible simulation of cognitive impairment. Previous research demonstrates that PVTs may be sensitive to dementia, thus inaccurately classifying real memory impairment as (...) simulation. Here, we analyzed the sensitivity of PVTs in discriminating between dementia and simulation using receiver operating characteristic curve analyses. Further, we examined the potential need for adjusting cut-off scores for three stand-alone and one embedded PVT for Portuguese older adults with dementia. The results showed that all measures, except for the Coin in Hand— Extended version, were sensitive to one or more sociodemographic and/or cognitive variables, and it was necessary to adjust cut-off points for all measures. Additionally, the Rey-15 Item Memory Test did not demonstrate sufficient discriminating capacity for dementia. These results present important implications for clinical practice and the daily life of patients, as the use of incorrect cut-off points could impede patients from getting the resources they need. Research teams have used extra-uterine systems to support premature fetal lambs and to bring them to maturation in a way not previously possible. The researchers have called attention to possible implications of these systems for sustaining premature human fetuses in a similar way. Some commentators have pointed out that perfecting these systems for human fetuses might alter a standard expectation in abortion practices: that the termination of a pregnancy also entails the death of the fetus. With Biobags, it might be (...) possible, some argue, that no woman has the right to expect that outcome if the technology is able to sustain fetal life _after_ an abortion. In order to protect the expectation that the termination of a pregnancy always entails the death of the fetus, Elizabeth Romanis has argued that fetuses sustained in Biobags have a status different than otherwise ‘born’ children. In support of that view, she argues that these ‘gestatelings’ are incapable of independent life. This argument involves a misunderstanding of the gestational support involved, as well as a misapprehension of neonatology practice. Here, we argue that any human fetus sustained in a Biobag would be as ‘independent’ as any other premature infant, and just as ‘born’. Neonatologists would seem to have certain presumptive moral responsibilities toward any human fetus gestating in a Biobag. It remains a separate question whether the perfection and widespread application of Biobags for premature human beings would or should alter the expectation that ending a pregnancy also entails fetal death. Abordamos aqui a influência do método de Condillac sobre a história da química. Partindo da confessada dívida de Lavoisier com o abade, propomo-nos a avaliar o aporte que o método condillaquiano terá para a filosofia natural da segunda metade do XVIII, colocando-a primeiramente na perspectiva da onda newtoniana que contaminou progressivamente as ciências a partir do fim do XVII. Mostramos então como o método de Newton, via alquimia, é capaz de inserir aspectos alheios ao mecanicismo estrito nas discussões, o que (...) garantirá à química legitimidade para se valer de conceitos como atrações e afinidades. Mais tarde, ao constituir e sistematizar um método geral de conhecimento marcado pelo modelo newtoniano, Condillac legará aos naturalistas meios para ordenar proficuamente novas regiões de conhecimento. Quando adequadamente adaptado por Lavoisier aos problemas químicos, este método promoverá a “revolução” da química, ou seu estabelecimento definitivo como ciência positiva. (shrink)

Nesta investigação, propomo-nos demonstrar que Jesus foi um verdadeiro contador de histórias. A narrativa lucana conhecida tradicionalmente por parábola do Filho pródigo não é propriamente uma parábola, pois assume os contornos formais de um conto, podendo-se nela encontrar as caraterística centrais do género literário “o conto”. Nela encontramos propriedades configuradoras da sua individualização como género: a conclusão moralizante de uma história fechada, com princípio, meio e fim; a concentração de espaço, tempo e reduzido número de personagens; a curta extensão sintagmática, (...) mas sempre extensa comparada com a das parábolas. Em suma, concluímos que estamos perante um verdadeiro e extraordinário conto. Há, no entanto, outras narrativas evangélicas que pelas suas características se assemelham à do Filho pródigo. Podemos assim identificar a do Administrador infiel, a narrativa dos Vinhateiros homicidas, a das Moedas de ouro e respetivos paralelos de Mt, que se revestem de característica muito semelhantes às do Filho pródigo, apesar de muito menos desenvolvidas e que, no fundo, as consideramos como sendo embriões de contos. ABSTRACT What, if anything, should we do when someone says they don’t believe in anthropogenic climate change? Or that they worry that a COVID-19 vaccine might be dangerous? We argue that in general, we face an epistemic duty to object to such assertions, qua instances of science denial and science sceptical discourse, respectively. Our argument builds on recent discussions in social epistemology, specifically surrounding the idea that we ought to speak up against (epistemically) problematic assertions so as to fulfil an (...) important epistemic obligation – namely, preventing epistemic harms in others. We show that both science denial (SD) and vaccine hesitant (VH) discourses are harmful in a distinctively epistemic sense, and as such generate an especially strong duty to voice our disagreement. As we also argue, this obligation is nonetheless defeasible: depending on the situational features of those involved, voicing an objection to VH discourse may actually end up doing more harm than good. We conclude by tracing what seems like a promising path towards restoring well-placed public trust in scientific testifiers. Doing so is key in order to guarantee equitable access to warranted beliefs about important subject matters, such as the safety of vaccines, to all segments of society. (shrink)

Este artigo apresenta a pertinência do olhar dissidente de Jan Patočka para a atualidade. A partir de sua obra fundamental, tecemos considerações em torno à sua perspectiva fenomenológico-existencial. O intuito é destacar seu engajamento filosófico existencial, a pertinência de suas críticas ao totalitarismo e sua preocupação com o avanço de uma tecnocracia que ameaça a existência humana. Argumenta-se que a postura filosófica do filósofo de Praga torna-se paradigmática para a conjuntura atual e para a práxis filosófica autêntica.

This paper consists in an analysis of two explanatory models of human behaviour which play a prominent role in the contemporary literature on human action. The first model - the causalist - aims at explaining action in terms of causes and general laws. The second model - the intentionalist - explains human action in terms of intentions and practical syllogism. Este artigo busca analisar o modo pelo qual a concepção de angolanidade interage com o mais recente processo de angolanização da economia angolana. É realizada uma breve abordagem histórica acerca das políticas culturais e também uma contextualização relativamente à economia política de Angola, abarcando dos anos da luta pela independência angolana até os dias atuais. O trabalho dedica especial ênfase aos anos do pós-guerra civil, quando o tema das políticas culturais, bem como o processo de angolanização, ganham maior ênfase na (...) agenda governamental e, por sua vez, encontram potencialidades e vulnerabilidades ao se relacionar com a histórica construção da angolanidade enquanto identidade nacional. O trabalho explora o modo pelo qual as concepções de angolanidade e angolanização ultrapassam os espectros das políticas públicas que visam, respectivamente, ao setor cultural e ao setor econômico, de modo que transcendem tais fronteiras e integram um complexo governativo que expõe as urgências e a dinamicidade da construção da nação angolana em um contexto pluriétnico. Engaging citizens with digital technology to co-create data, information and knowledge has widely become an important strategy for informing the policy response to COVID-19 and the ‘infodemic’ of misinformation in cyberspace. This move towards digital citizen participation aligns well with the United Nations’ agenda to encourage the use of digital tools to enable data-driven, direct democracy. From data capture to information generation, and knowledge co-creation, every stage of the data lifecycle bears important considerations to inform policy and practice. Drawing on (...) evidence of participatory policy and practice during COVID-19, we outline a framework for citizen ‘e-participation’ in knowledge co-creation across every stage of the policy cycle. We explore how coupling the generation of information with that of social capital can provide opportunities to collectively build trust in institutions, accelerate recovery and facilitate the ‘e-society’. We outline the key aspects of realising this vision of data-driven direct democracy by discussing several examples. Sustaining participatory knowledge co-creation beyond COVID-19 requires that local organisations and institutions incorporate adaptive learning mechanisms into their operational and governance structures, their integrated service models, as well as employing emerging social innovations. ABSTRACT The paper focuses on two issues approached by transhumanism: immortality and longevity. The first part present some contours of the transhumanist program and its motivation. The second discusses the extent to which the promise of immortality cannot be fulfilled by the idea of uploading the brain on the internet. The third part focuses on longevity. It shows why the transhumanist program for the elderly fails.

A Dirac-like equation for a massive field obeying the classical Proca equations of motion (PMO) is proposed in close analogy with Majorana’s construct for Maxwell electrodynamics. Its underlying algebraic structure is examined and a plausible physical interpretation is discussed. The behavior of the PMO equations in the presence of an external electromagnetic field is also investigated in the low energy limit, via unitary transformations similar to the Foldy-Wouthuysen canonical transformation for a Dirac fermion.

We apply the Galilean covariant formulation of quantum dynamics to derive the phase-space representation of the Pauli–Schrödinger equation for the density matrix of spin-1/2 particles in the presence of an electromagnetic field. The Liouville operator for the particle with spin follows from using the Wigner–Moyal transformation and a suitable Clifford algebra constructed on the phase space of a (4 + 1)-dimensional space–time with Galilean geometry. Connections with the algebraic formalism of thermofield dynamics are also investigated.

Tendo como referência O Nascimento da Tragédia de Friedrich Wilhelm Nietzsche, busca-se explicitar a particularidade da concepção nietzscheana de tragédia a partir de um duplo movimento: 1) Reconstrução das principais teses dos primeiros parágrafos da obra; 2) Demonstração da vinculação daquelas teses à tradição estética alemã do final do século XVII e do início do século XIX. Com isso se realça e reedita o diálogo intenso de Nietzsche com aquela tradição e se mostra as inovações e a radicalidade da sua (...) interpretação da tragédia. (shrink)

O artigo tem por objetivo investigar a particular relação que se estabelece entre a temática do início da filosofia – que é de extrema importância para toda a “escola fenomenológica de Freiburg” – e a concepção da essência da filosofia tal como desenvolvida especificamente no pensamento de Martin Heidegger e Eugen Fink. A partir da reinterpretação e radicalização operadas em relação à abordagem estabelecida pela fenomenologia husserliana, mostraremos como a figura de Husserl se impõe tanto como pano de fundo quanto (...) como alvo polêmico das reflexões de Heidegger e Fink. Assim, se o primeiro desenvolve uma concepção da filosofia como práxis radical de um “outro” pensamento, que procede por tentativas e experimentações, o segundo transforma a fenomenologia husserliana no sentido de uma filosofia da liberdade. O objetivo do artigo é apresentar como Simondon concebe o objeto técnico, a mediação e o ensino refletido da técnica. Num primeiro momento será apresentada a defesa dos objetos técnicos frente a acusação de restrição da experiência humana, da cultura. Num segundo, será apresentada a genealogia do objeto técnico, compreendido enquanto mediação entre o homem e a natureza, para então abordar o tema do ensino refletido da técnica.

Estudo introdutório de apresentação, seguido de tradução, da palestra “Fenomenologia e antropologia”, ministradas por Edmund Husserl nas sedes da Kantgesellschaft de Frankfurt, Berlim e Halle em 1931, na qual avalia criticamente, a partir dos pressupostos transcendentais da fenomenologia, a tendência da filosofia alemã dos anos 20 do século passado para uma antropologia filosófica.

A recent logical anti-exceptionalist trend proposes that logical theories are revisable in the same manner as scientific theories, either on grounds of the method of theory selection or on what counts as evidence for this revision. Given this approximation of logic and science, the present essay analyzes the commitments of both these varieties and argues that, as it currently stands, this kind of anti-exceptionalism is committed to scientific realism, that is, to realism about some unobservable entities evoked in logical theories. Henri Lefebvre, em O Direito à Cidade, afirmou que a cidade desde a Idade Clássica foi um objeto especial para o pensamento filosófico: a própria filosofia nasceu na cidade. Outra questão, destacou, seria pensar em um direito à cidade, como direito à vida urbana, transformada, renovada, um direito em formação que ainda não teria entrado nos códigos formalizados. Esse conceito, criado pouco antes de Maio de 1968 e empregado por diversos movimentos sociais desde o fim da década de 1960 até (...) os dias atuais, inclusive no Brasil, foi depois discutido, entre outros autores, por David Harvey. No entanto, esses autores não realizaram exatamente uma articulação com a filosofia do Direito. This sort of abuse of psychiatry and of the people in question is parallel to the abuse by the media or lay citizens when they describe, say, an especially violent murderer as a schizophrenic—forgetting that the vast majority of people with schizophrenia are not in the least violent. Having read Santa Teresa’s writings during my adolescence, well before I even considered entering medicine, I reacted to comments about her alleged psychiatric illnesses with uneasiness, to put it mildly. The Santa Teresa of La Vida de la Santa Madre Teresa de Jesús (her autobiography), of the Camino de Perfección, and of the El Castillo Interior was surely not a mental patient, it seemed to me. The same would apply to San Juan de La Cruz, Jean D’Arc, Don Quijote, Sancho Panza, Edipus, and Clitemnestra, to mention a few. Even van Gogh’s paintings did not seem to me the productions of a patient with schizophrenia or epilepsy. Of course all of them may have suffered, at certain periods of life, symptoms attributable to a mental disorder, but their creativity rested elsewhere, and was often manifest during healthy periods of their lives. After years spent fighting the stigma of mental diseases, and after organizing several exhibitions of works of art of people with mental diseases, we came to the conclusion that creativity and singularity belong to the person, not to the illness. Some of the diseases of these individuals may have being accidents (van Gogh’s hallucinations and psychotic symptoms, for example, were most probably due to intoxications with absinthe, then rich in hallucinogenic alkaloids such as tujone), or, together with other life circumstances, may have had unspecific influences on the person’s condition. In contrast with many other psychiatric disorders that are represented in ancient Greek and Roman literature, there are no descriptions of individuals with schizophrenia in the Greek and Roman literature dating from the fifth century bc to the beginning of the second century Ad (Evans et al. 2003), and several authors have speculated that schizophrenia did not exist before the eighteenth century (Ellard 1987).Caution is important when dealing with mental health and religious issues in contrast with creativity. The creativity of people suffering from bipolar disorders is well recognized (Jamison 1993) and [End Page 277] the same applies to alcohol and drug intoxication. Tellenbach (1986) has also written on the creativity of depressed persons, although he refers more to the disposition of mood (Schwermut) than to clinical depression as such. The link between melancholia and genius put forward by Aristotle has often been misinterpreted. The philosopher was considering the melancholic temperament and not the melancholic illness as we would understand it today. Of the four temperaments, it is in his view only the melancholic that is gifted with creativity. The sanguine person seeks the immediate pleasures of life, the choleric one considers himself powerful and dedicates himself to manifesting this power, and the phlegmatic individual is disconnected from life and seeks to live without effort or pleasure. The melancholic temperament leads to creativity because of the predominance of doubt, reflection, and dissatisfaction with the miseries of life.Freud’s notion of religiosity as a collective obsessive neurosis is totally mistaken, in my view. The three main themes of obsessions are cleanliness, order, and guilt. In none of these cases is the theme the goal of the action; rather, it is a strategy to contain anxiety. As a consequence, patients with obsessions and compulsions about dirt and cleanliness tend to be dirty themselves, because the real purpose of their compulsions is not in fact to be clean but rather to satisfy a ritual. Nesta investigação pretendemos captar o papel que a pregação cristã desempenhou, ao longo do período da patrística, na difusão do Evangelho. Na continuidade da evangelização levada a cabo pelos Apóstolos, os Padres da Igreja assumiram a herança do imperativo missionário, dado por Cristo: o catecumenato se cristaliza como instituição eclesial na Igreja do séc. III (_Katecumenoi_ no oriente, e _audientes_ no ocidente), mas recebe a herança de um processo de evangelização cujas raízes se estendem não só à missão levada a (...) cabo pelos próprios Apóstolos, mas também à missão evangelizadora do próprio Jesus. Por tudo isso, nos primeiros séculos, não podemos dissociar os conceitos de pregação e de educação. Centraremos a nossa atenção na figura de Santo Agostinho, salientando, por um lado, o seu contributo no lançamento dos alicerces teóricos e práticos da oratória sagrada, enquanto pastor e educador. A sua vida, a pregação, os seus escritos fizeram de Santo Agostinho o educador do ocidente, cuja matriz marcará definitivamente o futuro do cristianismo. (shrink)

O teórico Michael Löwy afirmou que o campo científico é social e politicamente condicionado, não sendo viável estabelecer um distanciamento entre ciência e ideologia. No atual momento, é possível visualizar a clareza dessa afirmação, na medida em que o campo científico se demonstra obstruído diante do cenário político vivenciado. O pensamento crítico e problematizador é tido como um perigo eminente perante a conjuntura conservadora e antidemocrática que se acentua. Com isso, a produção de pensamento crítico e o posicionamento de resistência, (...) diante da formação conservadora, assume a denominação de doutrinação, e o debate gerador de reflexão tende a ser calado, sobretudo se não confirmar a lógica dominante. Ao compreendermos a necessidade de reafirmar o teor questionador da produção de conhecimento, como elemento central na formação social, entende-se sua relevância na construção de um caminho democrático do pensamento social. Neste trabalho, buscamos levantar reflexões a partir de uma revisão bibliográfica, procurando entender produção de conhecimento em um período de anti-intelectualismo. Em contraposição ao conceito positivista de neutralidade do conhecimento, pretende-se investigar a relação dialética entre representação política e formação intelectual. Nossa concepção de pesquisa científica situa-se em um campo que não é neutro, mas permeado de diferentes concepções de mundo, de ser humano e de conhecimento, bem como engendrada por relações que ocorrem entre sujeitos, que propendem a produzir conhecimentos científicos a partir do seu lugar social, um lugar suficientemente privilegiado. Este trabalho se propõe examinar essas questões, ao referenciar a formação social como aspecto determinante na produção de conhecimento. Aponta-se à figura do intelectual orgânico como elemento essencial para pensar essa questão, ao salientar a contraposição ao retrocesso científico imposto no último período e a valorização do pensamento crítico, mais do que nunca como pensamento que resiste no campo da pesquisa e diante do sistema produtivista que o concebe.
